4. Consent management and settings
4.1 First information layer
On first accessing www.avomo.com/es, the user will be shown a first information layer or banner containing essential information on the use of cookies together with clear decision-making options. As a minimum, the banner includes equivalent mechanisms enabling the user to:
- Accept all non-essential cookies.
- Reject all non-essential cookies.
- Configure cookies by purpose or category.
The options to accept, reject and configure cookies are presented with an equivalent level of prominence. The design, colour, contrast, position and size of the buttons do not induce the user to give consent unintentionally. Scrolling through the page, continued browsing or the mere fact of remaining on the site do not constitute valid consent. Checkboxes for optional cookies are not pre-ticked.
4.2 Second layer and settings panel
This policy constitutes the second information layer. It remains accessible from the banner and, on a permanent basis, in the footer of the website. The user may modify or withdraw consent at any time by means of the permanent cookie settings link. Withdrawing consent is as easy as giving it.
4.3 Browser settings
In addition, the user may block or delete cookies through their browser settings. Doing so may affect the operation of certain features of the site.
5. Legal basis and international transfers
The legal basis for strictly necessary cookies is the technical necessity of providing the service requested by the user (Article 22.2 of the Ley 34/2002 de Servicios de la Sociedad de la Información y de Comercio Electrónico – Spanish Information Society Services and Electronic Commerce Act, LSSICE). For non-essential analytics, functional and advertising cookies, the legal basis is the user’s prior, freely given, specific, informed and unambiguous consent, in accordance with Articles 4(11), 6(1)(a) and 7 GDPR.
Certain providers of cookies and similar technologies may be located outside the European Economic Area or may process data from third countries, in particular where services provided by Google, Meta, LinkedIn or other global platforms are used.
Where an international transfer of personal data takes place, MOOVE CARS MOBILITY SPAIN, S.L. will apply the safeguards provided for by the GDPR, such as adequacy decisions, the EU-U.S. Data Privacy Framework where the provider is certified, standard contractual clauses and supplementary measures where necessary.
6. Effects of refusing cookies
Refusing non-essential cookies does not prevent general access to the website or to its main features. It may, however, limit the controller’s ability to measure aggregate use of the site, to display advertising relating to AVOMO and to improve the user experience on future visits.
7. Minors
The website www.avomo.com/es is intended for persons over 14 years of age. Should MOOVE CARS MOBILITY SPAIN, S.L. become aware that a child under 14 has given consent to non-essential cookies without the authorisation of their legal representative, that consent will be withdrawn and the associated data deleted.
| Country | Minimum age for consent |
| Spain | 14 years |
8. Rights, contact details and complaints
Users may exercise their rights of access, rectification, erasure, objection, restriction of processing and data portability, and may also withdraw consent, by contacting the Data Protection Officer:
dpo@moovecars.com
The general time limit for responding is one month from receipt of the request, which may be extended by a further two months in complex cases.
Users may also lodge a complaint with the competent supervisory authority:
| Country | Authority | Website |
| Spain | Agencia Española de Protección de Datos (Spanish Data Protection Agency, AEPD) | https://sedeaepd.gob.es |
9. Updates to this policy
MOOVE CARS MOBILITY SPAIN, S.L. will review this policy whenever the cookies or technologies used change, new providers are added, the purposes of the processing change, the consent system is modified, or there is a relevant legislative or case-law development.
Where the changes are significant, the user’s consent will be sought again by means of the banner or an equivalent mechanism. In any event, the technical cookie inventory will be reviewed at least once a year and following each significant modification of the site.
