1. What cookies and similar technologies are

Cookies are small files or identifiers that a website stores on the user’s browser or device when accessing a page. They allow navigation information, preferences, session data or interactions with the website to be remembered.

For the purposes of this policy, the term cookies also includes similar technologies for storing or accessing information on the user’s terminal equipment, such as tracking pixels, web beacons, scripts, local storage, session storage and, where applicable, fingerprinting techniques.

4. Consent management and configuration

4.1 First information layer

When accessing www.avomo.com/es for the first time, the user will be shown a first information layer or banner with essential information on the use of cookies and clear decision options. The banner includes, as a minimum, equivalent mechanisms to:

  • Accept all non-essential cookies.
  • Reject all non-essential cookies.
  • Configure cookies by purpose or category.

The options to accept, reject and configure are presented with an equivalent level of visibility. The design, colour, contrast, position or size of the buttons does not induce the user to accept unintentionally. Scrolling on the page, continued navigation or mere stay on the website do not constitute valid consent. Optional cookie checkboxes are not pre-ticked.

4.2 Second layer and configuration panel

This policy acts as a second information layer. It is available from the banner and, on a permanent basis, in the footer of the website. The user may modify or withdraw their consent at any time through the permanent cookie configuration link. Withdrawing consent is as easy as granting it.

4.3 Browser configuration

Additionally, the user may block or delete cookies from their browser settings. This management may affect the operation of certain functionalities on the website.

5. Legal basis and international data transfers

The legal basis for strictly necessary cookies is the technical need to provide the service requested by the user (Art. 22.2 LSSI-CE). For analytics, functional and advertising cookies that are not strictly necessary, the legal basis is the prior, free, specific, informed and unambiguous consent of the user, in accordance with Articles 4.11, 6.1.a and 7 of the GDPR.

Some providers of cookies and similar technologies may be located outside the European Economic Area or process data from third countries, in particular when using services from Google, Meta, LinkedIn or other global platforms.

Where an international transfer of personal data takes place, MC DIRECTORSHIP, S.L.U. will apply the safeguards provided for in the GDPR, such as adequacy decisions, the EU-US Data Privacy Framework when the provider is certified, Standard Contractual Clauses and supplementary measures where necessary.

6. Effects of rejecting cookies

Rejecting non-essential cookies does not prevent general access to the website or its main functionalities. However, it may limit the controller’s ability to measure the aggregate use of the website, display advertising related to AVOMO and improve the user experience on future visits.

7. Minors

The website www.avomo.com/es is addressed to persons over 14 years of age. If MC DIRECTORSHIP, S.L.U. detects that a minor under 14 has granted consent for non-essential cookies without authorisation from their legal representative, such consent will be revoked and the associated data will be deleted.

8. Rights, contact and complaints

9. Updates to this policy

MC DIRECTORSHIP, S.L.U. will review this policy whenever the cookies or technologies used change, new providers are incorporated, the purposes of processing change, the consent system is modified or there is a relevant regulatory or jurisprudential update.

Where the changes are significant, the user’s consent will be requested again through the banner or equivalent mechanism. In any event, the technical inventory of cookies will be reviewed at least once a year and after each relevant modification of the website.
